By placing an order online,
the Buyer acknowledges and agrees to
the following terms and conditions of sale.

Payment
Payment for Products ordered online shall be may in advance of the order
shipment by credit card, money order or electronic transfer of funds.
The buyer warrants that payments made by credit card banks are final and binding on the buyer and cannot be refunded by charge back. If the
buyer ignores this agreement and proceed with credit card chargeback,
the Seller will expect full payment plus a $50.00 USD chargeback
fee by other means such as money order or electronic funds transfer. If
repayment is not forthcoming within 10 days of chargeback notification,
the Seller retains the right to seek payment by any and all legal means.

Price and
Delivery The price will be that in effect on the date of delivery
unless otherwise agreed in writing and may be subject to applicable
federal, state, or local taxes. Prices for any Products not the subject
of a binding order may be changed or cancelled without notice. a) All
deliveries of Products shall be shipped to Buyer under the terms of the
Uniform Commercial Code and subject to delivery lead times. b) Special
delivery terms; deliveries of less than minimum order quantities;
specially requested analyses and/or deliveries in Seller non-standard
packages shall be subject to additional charges.

Warranty
against Defects of Products
The Seller warrants that the Products are fit for their intended purpose
when stored and used correctly. Any claim that the Products are unfit
shall be made to the Seller within 5 days from the date of delivery or,
where the defect is not apparent on reasonable inspection, within 5 days
after discovery of the defect. If the Buyer fails to so notify Seller or
the Products are already in use, the Products are deemed to have been
accepted.

Notification
of Loss, Damage to, or Non Delivery of Goods or Packages
In the event of any damages, short- or non-deliveries, the Buyer must
notify the Seller and the Carrier immediately in writing, otherwise no
claim can be entertained. At the same time the Buyer must mark and/or
make a reservation on the delivery note or on a similar document upon
receipt of goods and - if possible - have it countersigned by the
Carrier's driver.

Refunds: In special cases, we do accept returns
of unopened, undamaged formula jars within 30 days of shipment.
We will refund the cost of the formula less 15% restocking charges but
not the shipping costs. Starter packs are sold at a discount
and are not refundable Email support fees are not refunded and
will be applicable for 6 months, if email support is not used
immediately. Printed texts are refundable only if returned unopened in
original shrink-wrap .eBooks are not refundable. There are no refunds
on deliveries outside Canada and the USA. Please notify us by email and obtain instructions
for returning any Alpha Nutrition Products. You may not receive refund credit unless you
have contacted us first.

Consequential Loss
Seller shall not be liable for any direct, indirect or consequential
damages relating to, or in any way connected with, the sale and delivery
of Products to the Buyer.
|
Force
Majeure
The Seller shall be relieved of the performance of its obligations for
the duration and to the extent that it is prevented in the performance
of its obligations by reasons of force majeure. For purposes of this
clause, force majeure is defined as circumstances or events which have
not been foreseen at the time of entering into this transaction, which
are not the fault of the Seller and which prevent the performance of all
obligations hereunder and which are not capable of being remedied.

Assignability
This contract is personal to the parties hereto and shall not be
assigned to any third party by either the Buyer or Seller, without the
other party's written consent.

Law and
Jurisdiction
This contract shall be deemed to be made in British Columbia, Canada and
governed in all respects by British Columbia Law. |
